Subdivision of Land

Municipal regulation of land subdivision is governed by statutes found in Chapter 212 of the Texas Local Government Code.

HB 3167 “Shot Clock” Issues:

• The City of Arlington has a nice break-down of its approach to the “shot clock.”

Other Issues:

• “1445” Agreement. An older AG opinion that discusses 1445 agreements and how they are meant to function. Can be good background, but understand that the “urban county” limits on Subsection E of TLGC Ch. 232 were repealed in 2007.
• Condominium Projects: Regulating Condo Projects presented at the Texas City Attorneys Association Summer 2019 conference by Tad Cleaves and Skye Masson explains how condo projects are subject to Chapter 212 subdivision regs.
